1. Introduction
Welcome to eBus, a bus booking application created by We Code IT Technology Limited ("We Code IT," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the eBus application and the services provided through the application ("Service").
2. Service Description
The Service allows you to search for, book, and pay for bus tickets from various bus companies in your area. We do not own or operate any buses or bus companies, and we are not responsible for the quality or safety of the bus services provided by the bus companies.
3. User Accounts
To use the Service, you must register for an eBus account and provide accurate and complete information about yourself. You may only have one eBus account, and you must not share your account information with anyone else. You are responsible for keeping your account information confidential and up-to-date.
4. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Service.
5. Use of the Service
You may use the Service to book bus tickets, view bus schedules, and receive notifications and updates about your bookings. You must be at least 18 years old to use the Service.
6. Booking and Payment
6.1. Booking process: To book a bus ticket using the Service, you must provide your name, email address, mobile phone number, and payment information, such as your credit card number or other payment method. You must also select the bus route, date and time of departure and arrival, and seat number. After submitting your booking request, you will receive a confirmation email or SMS message.
62. Payment methods: We accept various payment methods, including credit cards, debit cards, and mobile payments. Payment must be made at the time of booking.
7. Refunds and Cancellations
7.1. Refund policy: Refunds for cancelled bookings are subject to the terms and conditions of the bus company and are not guaranteed. We Code IT is not responsible for refunding cancelled bookings, and any refunds are at the discretion of the bus company.
7.2. Cancellation penalties: Cancellation penalties may apply to cancelled bookings, as determined by the bus company. You will be notified of any cancellation penalties before you confirm your booking.
8. Prohibited Conduct
You agree not to:
Use the Service for any illegal or unauthorized purpose;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Harass, abuse, or harm another person;
Interfere with or disrupt the Service or servers or networks connected to the Service;
Use the Service to transmit any viruses, worms, or other harmful or malicious computer code;
Collect or harvest any information from the Service, including user information, without our prior written consent.
9. Intellectual Property
The Service and its content, including text, graphics, images, logos, and software, are the property of We Code IT or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reproduce any part of the Service without our prior written consent.
10. Disclaimer of Warranties
The Service is provided "as is" and without warranty of any kind. We Code IT makes no warranties, either express or implied, regarding the Service, including but not limited to the accuracy, completeness, reliability, or availability of the Service.
11. Limitation of Liability
We Code IT will not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of the Service or inability to use the Service.
12. Indemnification
You agree to indemnify and hold We Code IT and its affiliates, officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service.
13. Termination
We Code IT may terminate your access to the Service at any time for any reason, without notice or liability. You may also terminate your use of the Service at any time by deleting your account.
14. Governing Law
These Terms and your use of the Service are governed by the laws of Zambia, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the governing industries act of the laws of Zambia.
15. Changes to Terms
We Code IT may update these Terms from time to time. If we make any material changes, we will notify you by email or phone.
